Intermediate Care Facilities for Individuals with an Intellectual Disability or Related Conditions (ICF/IID)

Overview

ICF/IID provides residential and habilitation services to people with intellectual and developmental disabilities and/or related conditions.

Notice:

The Texas Health and Human Services Commission (HHSC) has approved payment rates for Non-State Operated Intermediate Care Facilities for Individuals with an Intellectual Disability or Related Conditions (ICFs/IID).
Rider 44 of the 2020-21 General Appropriations Act (GAA), House Bill 1, 86th Legislature, Regular Session, 2019 (Article II, Health and Human Services Commission) appropriates $5,000,000 in General Revenue and $7,712,942 in Federal Funds in fiscal year 2020 and $5,000,000 in General Revenue and $8,150,973 in Federal Funds in fiscal year 2021 for rate increases for the ICF/IID program.

The payment rate increases implemented in response to Rider 44 are effective retroactive to September 1, 2019. The rates are located on the ICF/IID page of the HHSC Rate Analysis Department’s website at https://pfd.hhs.texas.gov/long-term-services-supports/intermediate-care…, under the heading Payment Rate Information section, “Effective September 1, 2019 to current”.

On August 2, 2019, HHSC proposed rates for the ICF/IID program to be effective September 1, 2019, which contained a calculation error that would have resulted in rates that could not be supported by the level of appropriations.  In compliance with Section 355.201, Texas Administrative Code, HHSC has approved the rates that are published on the HHSC website. HHSC recognizes the calculation errors created challenges for providers and is taking steps to reduce the risk of errors in the future.

Cost Determination Process Rules applicable to the Intermediate Care Facilities for Individuals with an Intellectual Disability or Related Conditions program are located at Title 1 of the Texas Administrative Code, Part 15, Chapter 355, SubChapter A, Rules 101-112 and 114. 

The Intermediate Care Facilities for Individuals with an Intellectual Disability or Related Conditions (program-specific) Reimbursement and Cost-Finding Methodology are located at Title 1 of the Texas Administrative Code, Part 15, Chapter 355, SubChapter D, Rules 455-458.
